  • MEDICAL FORM AND WAIVER: A medical history form and liability waiver will be required of all partcipants before embarking on a Stay and Play adventure.

    MINIMUM AGE: Each adventure lists a participant's minimum age. Participants under the age of eighteen must be accompanied by a parent or legal guardian.

    RAIN OR SHINE: Unless the weather is deemed to be a safety hazard by our trained staff, the adventure will proceed. Refunds are not available unless the adventure is cancelled by Stay and Play Staff.

    CANCELLATION:  We understand that plans change.  Cancellations will be accepted up to fourteen days prior to your booking.  Rescheduling is permitted up to seven days prior to your booking.

    EXLUSION: We reserve the right to decline to accept any person as a participant in a tour or to end an individual’s participation in a tour at any time when such an action is determined by the appropriate  staff to be in the best interests of the health, safety and general well-being of the tour group or of the individual participant.

    VOID WHERE PROHIBITED:
    Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. Old Town Stay and Play Program and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited.

    GOVERNING LAW: In the event of litigation both parties agree that the Law of the State of business registration of Old Town Stay and Play Program shall apply and both parties shall consent to the jurisdiction of said State's courts, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by jury.

    MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between you and Old Town Stay and Play Program with respect to this Web site. The Terms and Conditions supercede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Old Town Stay and Play Program with respect to this Web site.
